The Global Settlement
Johnson & Johnson and the Plaintiffs’ leadership negotiating on claimants’ behalf have agreed to set up a private Talc Claims Resolution Program (“Program”) to resolve eligible talc claims. The Program is designed to resolve non-mesothelioma talc claims alleged to be caused by use of J&J Talc Products—that is, claims alleging epithelial cancer of the ovaries, fallopian tubes, and/or peritoneum. The Program is run by a settlement administrator, Archer Systems, LLC, under the oversight of counsel, with claims evaluated individually through a claims-processing platform. By entering into this settlement, J&J disputes the claims and denies any wrongdoing or liability; the Program is not an admission of fault.
The Settlement Terms
So long as a requisite number of filed claims take part in the Program, the settlement for eligible claims will proceed with no overall funding cap. Accordingly, claimants will receive the full value of their claim regardless of the total number of claims filed. The settlement has a guaranteed minimum amount of $5.5 Billion. Furthermore, claimants will not be responsible for the costs of administration of the Program, including settlement administration and lien resolution.
Law Firm and Claimant Participation
To take part in the Program on behalf of its clients, a law firm must execute a Participation Agreement and agree to its terms. To receive a copy of your law firm Participation Agreement, please register by clicking the button below.
Your law firm has five (5) days from receiving the Participation Agreement to execute it and provide a complete Exhibit A.
Once a law firm agrees to participate, the law firm’s clients will be able to enroll in the Program through the Registration Process described in the Participation Agreement and the Submission Procedures. Registration is collected by the settlement administrator rather than through a court filing.
To participate, a claimant must execute an Opt-In and Release—the document by which a claimant elect to join the Program, release the Released Parties, and authorize dismissal of her talc claim. Submitting a properly executed Opt-In and Release through Registration is what makes a claimant a “Participating Claimant.”
E-Notarization
NOTE: E-Notarization is REQUIRED to receive a disbursement under the Settlement Program. Accordingly, we recommend that you have your claimant e-notarize the Opt-In and Release through Docusign when registering so that the client does not have to again sign and notarize the Release at disbursement. However, if the claimant cannot e-notarize for some reason, the Settlement Administrator will accept an Opt-in and Release for Registration purposes that is not e-notarized. You MUST designate on Exhibit A if the claimant should receive a Docusign package with e-notary or without e-notary.
